View Full Version : Chili Peppers sue the makers of Californication

Ironically, the TV show is better than the band ever were, but such is life.

I don't believe the executive producer's story about how he discovered the name for one minute, but I would also have thought the Peppers had enough money already.


The Red Hot Chili Peppers are suing Showtime Networks, claiming they stole the title of their series Californication from the band's album and single of the same name.

The lawsuit alleges unfair competition, dilution of the value of the name and unjust enrichment, claiming the title is "inherently distinctive, famous ... and immediately associated in the mind of the consumer" with the Red Hot Chili Peppers.

The Chili Peppers's landmark album sold more than 14 million copies, received a Grammy nomination in its year of release (1999) and was named on of Rolling Stone magazine's Top 500 Albums of All Time.

Proving its "enduring popularity" the band cite that the single of the same name has been legally downloaded nearly half a million times.

The band have filed for damages on five counts in the California Superior Court.

"Californication is the signature CD, video and song of the band's career, and for some TV show to come along and steal our identity is not right," said the band's lead singer, Anthony Kiedis, in a statement.

The television series stars David Duchovny as a novelist suffering from writers' block and a mid-life crisis.

The show features a character named "Dani California," which is also the title of a Red Hot Chili Peppers song released in 2006, according to the lawsuit.

The suit also names the show's creator and executive producer, Tom Kapinos, and two production companies, Twilight Time Films and Aggressive Mediocrity, Inc.

A call to Showtime's lawyers was not immediately returned. Attempts to find a listing for Kapinos were not successful.

The suit seeks a permanent injunction barring Showtime and the other defendants from using the title Californication for the show, damages and restitution and disgorgement of all profits derived by the defendants.

In July 2007, Kapinos, told reporters at a Television Critics Association press tour in Beverly Hills that he first heard the term in Oregon.

"Apparently in the '70s there were bumper stickers that said 'Don't Californicate Oregon,' because Californians were coming up there, and I just through it was a great, great title for this show," said Kapinos

As soon as a band starts saying things like "associated in the mind of the consumer" they've lost my respect. But then again they would have to have had my respect in the first place, so....

At the same time I'll admit when I first saw the ad for this show the Chilli's were the first thing that popped into my head. I can't believe the creators didn't look into it a bit more thoroughly.

Tell me about it....

I mean, I am not a fan of the Chili Peppers, so I might be biast, but seriously, I think they have enough cash, and I don't think the show it hurting the band image at all....if that was at all possible anyway. Their the Chili Peppers for Gods Sake.

I really hope this doesn't go anywhere.
The band should be happy Showtime wanted to use a name "associated with them in consumers minds" for such a great show.

When I first heard of the show, the song and the band were the first things I thought about. Probably alot of other people thought the same as well. Is it a good or a bad show? If its a bad one then no wonder they dont want people thinking they had something to do with it.

I like it. Its edgy, funny and a little bit rude. Obviously the idea for the title came from the Peppers song, but I don't think the show would do anything to damage their reputation at all. It just seems like a grab for cash to me.

I think it's slightly retarded that the creators were like, "Oh, really? Californication is associated with the Chilli Peppers? Because it's also a complete and total coincidence that one of the characters on the program is named after a Chilli Peppers song (Dani California)".

I do agree that the band are being a little diva-esque about this. If anything they should thank the creators for reminding the public of their relevance. I mean, who really cares about the Peppers when they're not on the radio or MTV? I wouldn't say many people do.

Did you read how a group of Christian fundamentalists have been holding prayer vigils in the Channel 10 carpark to pray for the souls of Californication's producers. Hope that's working out well for them. :lol

i don't think it is about RHCP wanting more money. It's clearly about keeping control of their artistic products. Calling the show "Californication" is stealing----no matter how you spin it. Their relevance as a band has nothing to do with it.

The term Californication has been around since the 70s. Maybe Time magazine should sue RHCP since they first used the phrase.
